Travis Barker Sues Learjet Over Crash


Travis Barker is seeking a different kind of closure.

The former Blink-182 drummer has filed a negligence lawsuit against the owner and makers of what he claims was a “defective” Learjet that crashed Sept. 19, killing four and leaving Barker and Adam “DJ AM” Goldstein with severe burns. (View the lawsuit.)

Per court documents filed Friday in Los Angeles Superior Court, Barker’s camp believes that “one or more of the tires failed, leaving tire debris and portions of airplane components along the 8,600 foot runway” and the pilot made a “negligent attempt to abort the takeoff.”

“The pilot’s decision was a breach of their duty owed to the passengers onboard and was a substantial factor in causing the crash and resultant injuries and deaths,” the suit continues.

Moreover, the jet’s “landing gear, tires, wheels, brakes, reverse thrust system, squat switches and component parts were not airworthy.”

Earlier this week, the Federal Aviation Administration released recordings from the fateful flight in which copilot James Bland, who also died in the crash, could be heard saying, “Roll the equipment; we’re going off the end [of the runway].”

The plane then ran off the runway, striking airport lighting, navigational facilities and a perimeter fence, crossed a highway, and crashed into an embankment.

An investigation being conducted by the National Transportation Safety Board into the circumstances surrounding the crash is currently under way, but may take as long as a year to complete.

Learjet manufacturer Bombardier, Inc., charter services Clay Lacy Aviation and Global Exec Aviation, and Goodyear Tire and Rubber are named as defendants, all of whom, according to the complaint, are liable for Barker’s “pain and suffering, mental anguish, psychological and emotional distress and disfigurement and pre-impact fear of death and burning.”

Thelma Martin Still, the mother of security guard Charles Still, who died in the accident, is also party to the suit. She and Barker are seeking at least $25,000 in damages.

And, according to one expert, they definitely have a case.

“When you are a passenger on an aircraft the pilot and the company that leases the plane and flies the plane are responsible for passenger safety and to get them safely to their destination,” said attorney Mary Schiavo, a former FAA employee who is not involved in this suit but has experience with aviation litigation. “Anyone on that plane would have an extremely good case.”

“In most cases, if the proof points to the pilot error you would look to their employer, as long as they were performing in the scope of their duty…When you hit that speed [153 mph] you are trained from your beginning days as a private pilot on up is you have to go,” Schiavo tells E! News. “But they may have blown a tire, so who knows what their options were.”

Barker and DJ AM had chartered the private flight to Los Angeles after playing a free show at the University of South Carolina. In addition to Still, Barker’s assistant Chris Baker, pilot Sarah Lemmon and Bland, the copilot, were all killed.

At least one of the defendants, however, says that it was in no way involved in the crash.

“We were not involved, not our aircraft or our crews,” Duke Tonry, public information officer for Clay Lacy Aviation, tells E! News. “We don’t understand the connection and we haven’t been informed of the lawsuit. We are often called for referrals and while I was not personally involved in this trip we are talking about, maybe we were called and [we] referred [them] to [Global Exec Aviation].”

A rep for Global Exec had no comment on the litigation.

It’s god to know that he is staying positive:

Recovering rocker Travis Barker will pour his heart out about the plane crash that killed his best friends last month in a new album.

The former Blink-182 drummer and his pal Adam ‘DJ AM’ Goldstein were the only survivors after the Learjet they were passengers on failed to clear a runway in South Carolina and burst into flames. Four people died in the September crash, including Barker’s assistant and close pal Chris Baker.

Barker considers himself lucky to be alive, and is desperate to return to the studio and use the tragedy to inspire new music.

He tells Us Weekly magazine, “I can’t wait to work on my records. I lost one of my best friends in this crash. I can’t wait to get back to writing and expressing myself, get back into the swing of things. I have so much stuff just jumbled in my head right now. I can’t wait.”

Thank God he and DJ AM were blessed to make it out safely. Let’s not forget those who weren’t so lucky.

Drummer Travis Barker has been released from the Joseph M. Still Burn Center at Doctors Hospital in Augusta, Georgia. Barker  had been recovering at Doctors Hospital after suffering second and third degree burns following a Learjet crash that killed four people and injured his good friend DJ AM. “Travis Barker was discharged from the Joseph M. Still Burn Center at Doctors Hospital this morning,” a spokesperson for the hospital said.

DJ AM was released from the burn-center on Friday and stated on his Facebook page “Adam Goldstein is the luckiest guy alive.”

Good news. Word is that these guys saved each other. Thank God for their quick thinking.

Celebrity disc jockey DJ AM has been released from a Georgia hospital after suffering severe burns in a fiery plane crash a week ago, a spokeswoman for the musician said Friday.

“While he is deeply saddened by the events he is thankful for all of the love and support he has been receiving from fans and friends,” spokeswoman Jenni Weinman said in a statement.

DJ AM, whose real name is Adam Goldstein, and former Blink-182 drummer Travis Barker, were rushed to a burn hospital in Augusta, Ga., after their Learjet crashed on takeoff from a Columbia airport. Doctors have said they expect both men to fully recover.

Two pilots and two other passengers who were close friends of the musicians were killed in the crash just before midnight Sept. 19.

An officer who was among the first on the scene said the musicians told him they escaped the flaming wreckage by sliding down a wing.

A hospital spokeswoman would not say when Barker was expected to be released. The head of the burn hospital said it can take up to one year to heal from the second- and third-degree burns the men suffered. But Dr. Fred Mullins said he didn’t expect it to take that long for the musicians to heal.

The Learjet shot off the end of the runway, ripped through a fence and crossed a highway before coming to rest. Officials with the National Transportation Safety Board have not said what caused the crash, but spokesman Peter Knudson said he expects the agency to release a preliminary report next week.

NTSB officials have said a cockpit voice recorder revealed that crew members thought a tire blew and tried to abort the takeoff. Investigators recovered pieces of tire from the runway.

Barker was one of the more colorful members of the multiplatinum-selling punk rock band Blink-182. DJ AM is a popular disc jockey who was also a tabloid favorite for some celebrity romances.

Finally some good news after this tragedy:

A doctor has announced that Travis Barker and DJ AM are expected to have a full recovery after yesterday’s horrific plane crash.

Barker and Adam “DJ AM” Goldstein were severely burned yesterday when their Learjet crashed before takeoff from a Columbia, South Carolina airport. The crash killed four people, including Barker’s assistant Chris Baker.

Dr. Fred Mullins, medical director of the Joseph M. Still Burn Center, said both Travis and Adam suffered second and third-degree burns. Mullins said Barker’s torso and Adam’s hands and part of his head were burned.

According to sources, Barker and DJ AM survived the crash by jumping out of the door of the Learjet. The plane was already in flames at the time the two jumped. Travis Barker has been burned from the waist down, but he is expected to survive the plane crash. DJ AM’s face was severely burned and is being tended to right now. Travis Barker’s assistant, Chris Baker, who was featured on the reality show “Meet the Barkers” was one of the four people who died in last night’s plane crash in Columbia, SC. Baker, 29, died along with the pilot Sarah Lemmon, co-pilot James Bland and Charles Still, who was Travis’ bodyguard. Barker had performed Friday night with Perry Farrell, Gavin DeGraw and DJ AM. Gavin Degraw’s father has told a local paper in SC Degraw was not on the plane and is still in Columbia.

A FAA spokesperson said the plane carrying six people attempted to take off shortly before midnight Friday from Columbia, South Carolina when people in the tower report seeing sparks. They said the plane went off the runway and crashed on a highway embankment, catching fire.

Former Blink-182 drummer Travis Barker and a popular disc jockey were critically injured in a Learjet crash in South Carolina that killed four people, authorities said Saturday.

Federal Aviation Administration spokeswoman Kathleen Bergen said the plane carrying six people was departing shortly before midnight Friday when air traffic controllers reporting seeing sparks. The plane went off a runway and crashed on a nearby road, she said.

Hospital spokeswoman Beth Frits said Barker and DJ AM, whose real name is Adam Goldstein, were in critical condition at a burn center in Augusta, Ga., about 75 miles southwest of Columbia.

NBC News reported that Barker, who also starred in MTV reality show “Meet the Barkers”,  had performed Friday night at an event alongside Perry Farrell, the former Jane’s Addiction singer, as well as Gavin DeGraw and Goldstein.

The killed passengers and two crew members, all from California, were identified as pilot Sarah Lemmon, 31, of Anaheim Hills; co-pilot James Bland, 52, of Carlsbad; Chris Baker, 29, of Studio City; and Charles Still, 25, of Los Angeles, NBC News reported.

“It’s absolutely terrible and tragic,” Columbia Mayor Bob Coble said.

Bergen said the Lear 60 was headed to Van Nuys, California. She was unable to confirm the names of those on board.

Barker and Goldstein perform together under the name TRVSDJ-AM.

After Blink-182, Barker went on to form the rock band (+44) — pronounced “plus forty-four.” He appeared in “Meet the Barkers” with former Miss USA Shanna Moakler, to whom he was married at the time. The show documented the former couple’s lavish wedding and life.

Goldstein at one time was engaged to celebrity Nicole Richie.
